Dismissed due to granting of a Motion to Suppress

The Federal Government charged my client with Possession of a Firearm by a Convicted Felon despite the fact that my client had already, previously plead guilty to this charge in Henry County in the same transaction of events as indicted in Federal Court. I successfully argued a Motion to Suppress before the Magistrate Court arguing that law enforcement unlawfully searched the area where the firearm at issue was located. The District Court adopted the Report and Recommendation of the Magistrate Court. The Government initially appealed this ruling to the 11th Circuit Court of Appeals. However, on Friday, July 29, 2016, the Government filed a motion to dismiss their appeal.
